Accused of shouting ‘Pak Zindabad’, man gets bail on one condition: Salute Tricolour 21 times twice a month, while raising ‘Bharat Mata Ki Jai’ slogan

The Madhya Pradesh High Court Tuesday granted bail to a man accused of shouting the slogan, “Pakistan Zindabad Hindustan Murdabad”, on the condition that he salute the national flag 21 times, twice a month, while raising the slogan “Bharat Mata Ki Jai”. The accused, Faizan, was arrested by the police in Bhopal following an FIR registered on May 17 this year, and had been in detention since. The prosecution had argued that the accused intended “to promote enmity between different groups and his act is prejudicial to maintenance of harmony and national integration”. Granting bail to the accused, Justice Dinesh Kumar Paliwal directed that Faizan continuously mark his presence at the local police station between 10 am and noon, on the first and fourth Tuesday of the month, till the conclusion of the trial. During his visit to the police station, the accused “shall salute the national flag unfurled on the building of the police station 21 times, raising the slogan ‘Bharat Mata Ki Jai’. The aforesaid condition has to be necessarily incorporated in bail papers,” the court said. The bail bond was set at Rs 50,000. The prosecution had claimed they had a video of the accused shouting the slogan, but the bail hearing had gone through a delay of several months after the video was not produced before the court. On September 17, Ashok Khalko, director of the Forensic Cyber Cell in Bhopal, appeared before the court and informed that at present, “3,400 matters are pending before Forensic Cyber Lab for examination and he is having only four persons to examine and retrieve the material sent by police stations in Madhya Pradesh ”. The court then directed the state government to provide sufficient staff to the Forensic Cyber Lab to enable it to furnish reports well in time. Faizan’s lawyer Hakim Khan told the court that he was falsely implicated in the case, but agreed that his client was seen in a video shouting the slogans. Government advocate C K Mishra argued that the accused was a habitual offender and had 14 criminal cases registered against him. “He is openly shouting slogans against the country in which he is born and brought up. If he is not happy and satisfied in this nation, he may opt to live in the country of his choice for which he raised the slogan of zindabad,” Mishra argued. None
